LUMIPLAYER — Video & Music Player

Welcome to LUMIPLAYER (“LUMIPLAYER”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the LUMIPLAYER mobile application, website, and related services collectively referred to as the “Service”.

By downloading, installing, accessing, or using LUMIPLAYER, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

LUMIPLAYER is a video and music player designed for personal entertainment, supported media links, playlists, favorites, Jamendo music discovery, and background audio playback where permitted.

Features may include video playback, music playback, supported media link playback, search, playlists, favorites, recently played items, background audio controls, and content discovery sections powered by third-party or publicly available providers.

LUMIPLAYER does not claim ownership of third-party music, video, artwork, metadata, or streaming content. Content remains the property of its respective owners, licensors, artists, publishers, or providers.

2. Eligibility

You may use the Service only if you are legally able to enter into a binding agreement in your jurisdiction and only in compliance with applicable laws and platform rules.

You agree to use LUMIPLAYER only for lawful, personal, and non-commercial purposes unless the applicable content license expressly allows broader use. You must not:

4. Jamendo Music and Licensing

LUMIPLAYER may integrate Jamendo APIs or Jamendo content discovery features. Jamendo content is made available by artists, rights holders, or Jamendo under the license attached to each track, album, work, or item.

Jamendo’s API Terms state that content available through the API is published under a Creative Commons license and that the selected license is indicated on the relevant Jamendo content page. You must use each track in conformity with the license under which it was published.

LUMIPLAYER may filter Jamendo content before displaying it in the app. In the ad-supported version of the Service, we may only display or enable playback for tracks that appear to allow commercial use based on the license metadata available to us, such as certain Creative Commons Attribution licenses. Tracks with NonCommercial license restrictions may be excluded from ad-supported playback.

License metadata may be provided by Jamendo or other third-party sources. While we make reasonable efforts to display accurate artist attribution, source links, and license information, users are responsible for reviewing the license attached to each track before using content outside personal in-app listening.

Creative Commons licenses may include conditions such as Attribution (BY), NonCommercial (NC), ShareAlike (SA), or NoDerivatives (ND). These conditions are not identical:

LUMIPLAYER may show track title, artist name, artwork, source link, and license link when this data is available from Jamendo. Users are responsible for checking the license attached to each track before using it outside ordinary personal listening inside the app.

Jamendo Licensing and Jamendo Music may provide different rights for different uses. If you need commercial synchronization, business background music, advertising, video production, public performance, or other commercial use, you may need a separate license from Jamendo Licensing or the rights holder.

LUMIPLAYER is not affiliated with, endorsed by, sponsored by, or officially connected with Jamendo unless explicitly stated. Jamendo names, marks, and content belong to their respective owners.

5. Content and Licensing

Music, videos, streams, artwork, titles, artist names, metadata, and other content available through the Service may be provided by external services, public content providers, Jamendo, licensed media providers, or user-selected links.

Availability of specific content may change at any time due to licensing, regional restrictions, provider policies, technical changes, or rights-holder requests. We do not guarantee that any specific track, video, playlist, artist, album, or source will remain available.

6. Background Playback

LUMIPLAYER may support background audio playback for content and sources that permit such use. Background playback behavior can depend on the operating system, device settings, provider terms, content licensing, battery optimization settings, and app permissions.

The Service must not be used to bypass subscription features, access restrictions, digital rights management, platform policies, or technical protections of third-party content providers.

Unless explicitly stated in the app, LUMIPLAYER does not provide offline downloading, ripping, extraction, or permanent storage of third-party media. Playback features are intended for lawful streaming and personal listening or viewing within the app.

7. Third-Party Services

LUMIPLAYER may integrate third-party services for content delivery, analytics, diagnostics, advertising, hosting, or app functionality. These services operate under their own terms and privacy policies. Third-party services may include Jamendo, Firebase, Google AdMob, Apple and Google platform services, and other public or licensed media APIs.

8. Advertising

To support development and maintenance, LUMIPLAYER may display advertisements. Advertising providers may process device identifiers, advertising identifiers, app interaction events, and approximate location derived from IP address to deliver and measure ads, depending on your device settings and consent choices.

9. Intellectual Property

The LUMIPLAYER app, brand, logo, design, interface, graphics, software, and related materials are protected by intellectual property laws. You may not copy, reuse, or create derivative works from the app or branding without permission. All third-party content remains owned by its respective rights holders.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how information may be collected, used, and processed.

11. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or always-available operation. Features, content sources, and availability may change, be limited, or be discontinued without notice.

12. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability or reliability.

13. Limitation of Liability

To the maximum extent permitted by law, LUMIPLAYER and its operators shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of data, profits, business, or opportunities arising from use of or inability to use the Service.

14. Changes to These Terms

We may update these Terms from time to time. When changes are made, the “Last Updated” date will be revised. Continued use of the Service after updates means you accept the updated Terms.

15. Apple Standard EULA

If you download LUMIPLAYER through Apple’s App Store, your use of the app may also be subject to the Apple Standard End User License Agreement, unless a separate custom EULA is provided.
